1. Introduction
Welcome to aapla manus (“we”, “our”, or “us”). These Terms & Conditions (“Terms”) govern your use of our website aaplamanuss.in, our marketing services, communication platforms, and any related digital tools or APIs we operate, including Meta’s WhatsApp Business API and RCS-based communication systems.
By accessing or using our website and services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you must immediately stop using our services.
These Terms constitute a binding legal agreement between you (the “User”, “Client”, or “Customer”) and aapla manus, a marketing agency operating as a sole proprietorship based in Pune, India.
2. Definitions
For the purpose of these Terms:
- “Business” / “Company” means aapla manus, its owner, agents, employees, and authorized representatives.
- “User” / “Client” refers to any person, organization, or entity that accesses, subscribes to, or avails any service offered by aapla manus.
- “Services” include marketing consultation, digital campaign management, WhatsApp Business and RCS integration, communication automation, and other related activities.
- “Website” refers to aaplamanuss.in.
- “RCS” means Rich Communication Services — a modern communication protocol used by telecom networks and businesses.
- “Meta” refers to Meta Platforms, Inc., the parent company of WhatsApp and its affiliated products.
- “Agreement” means these Terms & Conditions including all updates and future modifications.
3. Acceptance of Terms
By using our Services, registering an account, or engaging with our campaigns via WhatsApp or RCS, you confirm that:
- You have read and understood these Terms;
- You have the authority to enter into a binding agreement; and
- You agree to abide by all applicable laws and regulations in India regarding digital communication and marketing practices.
4. Description of Services
aapla manus provides professional marketing and communication services including, but not limited to:
- WhatsApp Business API & RCS-based promotional messaging
- Brand awareness and campaign strategy
- Lead generation and customer engagement
- Content creation, design, and distribution
- Market analytics and reporting
- Digital consultancy for small and medium enterprises
We reserve the right to modify, suspend, or discontinue any part of our Services at any time without prior notice, provided that no such changes affect ongoing contractual obligations without mutual agreement.
5. Eligibility
To use our Services, you must:
- Be at least 18 years old;
- Be legally capable of entering into contracts under the Indian Contract Act, 1872;
- Use the Services solely for lawful business or marketing purposes.
We may refuse service or terminate your account if we believe your use violates these conditions or applicable law.
6. Account Registration
Certain Services may require account registration. During registration, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account.
You agree to immediately notify aapla manus if you suspect unauthorized access or any security breach.
7. User Responsibilities
You agree not to:
- Use the Services for unlawful, misleading, or fraudulent communications;
- Send spam, bulk messages, or unsolicited promotions;
- Violate Meta, WhatsApp, or telecom operator guidelines;
- Infringe any third-party intellectual property rights;
- Misrepresent your business identity or purpose.
You are solely responsible for the accuracy of your marketing content, including text, media, or any customer data shared with us.
8. Payment & Billing Terms
All service fees, subscriptions, or one-time charges must be paid as per the quotation or invoice shared by aapla manus.
- Payments are due before the commencement of any campaign or service delivery.
- We accept payments via authorized digital modes or bank transfer.
- Once a project has commenced, payments are non-refundable, except as required by Indian law.
Any delay or non-payment may result in suspension of service and additional charges.
9. Subscription Renewal & Termination
Some services may be offered on a subscription basis. Unless cancelled in writing at least 7 days prior to renewal, your subscription will automatically renew.
Either party may terminate this agreement by providing written notice. Upon termination:
- All pending dues must be cleared.
- User data may be deleted after a reasonable retention period.
- No refunds will be issued for partial periods.
10. Use of WhatsApp Official API & RCS
Our Services may involve integration with WhatsApp Business API (provided by Meta) and RCS messaging (provided by telecom operators).
By using these communication channels:
- You agree to Meta’s Business Policy and WhatsApp Commerce Policy.
- You consent to message delivery through telecom and third-party systems.
- You are responsible for ensuring message templates comply with applicable communication laws and do not violate user privacy.
11. Message Delivery & Compliance Policy
Message delivery may depend on telecom operator networks, user devices, or WhatsApp server conditions.
aapla manus is not responsible for delays, delivery failures, or disruptions caused by third-party providers.
We adhere to TRAI and Meta’s compliance requirements and expect clients to do the same, including maintaining opt-in/opt-out mechanisms for end-users.
12. Intellectual Property Rights
All materials, logos, trademarks, text, graphics, and software developed or used by aapla manus remain the exclusive intellectual property of the company unless otherwise agreed in writing.
Clients retain ownership of their own brand assets but grant aapla manus a limited license to use them for service execution.
Unauthorized reproduction, copying, or resale of our materials is strictly prohibited.
13. Confidentiality
Both parties agree to maintain the confidentiality of any sensitive information exchanged, including client data, campaign strategies, and communication templates.
We implement reasonable measures to safeguard data, but we cannot guarantee absolute security due to the nature of the internet.
14. Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis. aapla manus does not guarantee uninterrupted service or specific marketing outcomes.
We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
15. Limitation of Liability
To the fullest extent permitted by law, aapla manus shall not be liable for any indirect, incidental, or consequential damages arising from:
- Message delivery failures;
- Misuse of data by third parties;
- Downtime or server errors;
- Loss of revenue, business, or goodwill.
Total liability shall not exceed the amount paid by the client for the service that caused the claim.
16. Indemnification
You agree to indemnify and hold harmless aapla manus, its proprietor, employees, and partners from any claims, damages, or liabilities arising out of:
- Your breach of these Terms;
- Your misuse of WhatsApp, RCS, or communication tools;
- Any violation of law or third-party rights.
17. Governing Law (India)
These Terms shall be governed by and construed under the laws of India.
Jurisdiction for any dispute shall lie exclusively with the courts of Pune, Maharashtra.
18. Changes to Terms
We reserve the right to modify these Terms at any time. The updated Terms will be posted on aaplamanuss.in with the revised date. Continued use of our Services constitutes acceptance of the updated Terms.
